The family of Malyia Jeffers, a baby who had to have her limbs amputated, was just granted $10 million dollars for the mismanagement of their daughter’s care. The offense was committed by the employees of Methodist Hospital in California. The child had been left in the waiting room for too long to treat an infection, leading to the amputation of the girl’s limbs.
The hospital is going to pay $9 million, and the Emergency Physicians Medical Group of Sacramento will pay the rest. The money is going to go toward current expenses for the child’s care, and another $16,000 per month for Malyia, starting in 2026, when she turns 18 years old.
The state currently has a $250,000 cap on “pain and suffering.” But in this case, other types of damages were considered. The girl was brought into the hospital in November to be treated for a Strep infection. Doctors left her in the waiting room for five hours without any treatment.
Later, she was diagnosed at the Stanford University Hospital to have Septic Shock, which led to the amputations of her feet, her left hand and part of her right hand.
"When the bacterial infection goes through the bloodstream, you have sepsis and a problem with your blood clotting ability. As a result, [the infection] cuts off the blood flow to the extremities and those areas die," said Dr. Ari Brown, a pediatrician.
Freaking ridiculous. Why does this foolishness persist.
ReplyDeleteThis is an absolute shame. That poor baby. As a parent I can tell you that you can't put a pricetag on my child's livelihood. Yes I would expect my baby to be well compensated but I couldn't honestly tell you an amount of money I think would suffice. This is just sad. God bless that baby and her family. SMH.
ReplyDeleteIf this patient had no "paid" health insurance. this "could" establish a new standard of health care for the uninsured. That learned? IF you want health care, you had better have insurance! Now that's the big IF!

ReplyDeleteThis is so sad. No amount of money can compensate for that lil babies body parts. Someone should loose their license and job because of this. A new case for National Health Care. I have had to have emergency treatment and I had to wait 5 hours, I had breathing problems. If it were not by the grace of God I could have died there. Hospitals have become desenstized to pain and suffering.
ReplyDeleteIf you look closely you can see a that a tear has rolled down on the babies face. So sad, so sad, this brings tears to my eyes. I hope that the person(s) responsible for this has a vision of this child forever.
I have children with disabilities an I wish this life on no one those doctors should be ashamed of themselves. This is a horrific tragedy that could have been prevent. Blessings and strength to this beautiful child and her family.
ReplyDeleteIt really breaks my heart to know that kids have to suffer from adults mistakes. When you take your kids to the emergency room for a bruise or something they call CPS and accuse the parents of child abuse or if the child is underweight or left in an area for a minute or two they call it child neglect, but when a child comes to them sick and they neglect to see what is wrong or even attempt to see what is wrong, then they(doctors/nurses) are just as worse as the parents who are abusing and neglecting their kids.The doctors and nurses need to do better in any and all situations when it comes to an infant being sick and brought into the ER because an infant cannot talk and say what is wrong with them, so when a parent brings a child into a hospital for emergency help and they do not know what is wrong, I feel that the doctors and nurses should at least check them to make sure that there is nothing seriously wrong with that child. ReplyDeleteThis just helps in telling the story of why health insurance is so important. ER's across this country are filled with uninsured or underinsured individuals that do not have access to adequate healthcare, they are then "in the way" of the true emergencies. This is not a new epidemic either, people have been using ER's for basic medical care for decades!!!! Praying for the emotional healing of this family.
